Terms and Conditions

Welcome to SoMax Finance (“SoMax”). These terms and conditions ("Terms") govern your use of the SoMax website and any mobile application ("App") that is made available on Apple platforms, including iOS and iPadOS (the website and App are hereafter referred to collectively as the “Technology”).

1. Acceptance of Terms

By downloading, installing, or using the Technology, you agree to be bound by these Terms. SoMax may change the Terms at any time by posting a revised version on its website. Any change shall come into effect and be deemed accepted if you continue using the Technology after the revised version is posted. Please review these Terms carefully before you use the Technology, and continue to check here periodically for any updates.

2. User Accounts

Some features of the Technology may require you to create a user account. When doing so:

  • You will be asked to provide your first name, last name, role (where relevant), email address, and mobile telephone number.
  • You agree to provide accurate and complete information during the registration process and to update such information to keep it accurate and current.

3. Licence

SoMax grants you a non-exclusive, non-transferable, royalty-free revocable licence to use the Technology in accordance with these Terms. Usage of the Technology is free of charge, although we reserve the right to impose charges at our sole discretion, and on reasonable notice to account holders. All trademark rights, copyright, database rights and any other intellectual property rights of any nature vesting in the Technology together with the underlying software code are exclusively owned by SoMax and/or its group of companies (as prescribed between them).

4. Conditions of Use

  • You will comply with all applicable laws and regulations and will not use the Technology for any improper or fraudulent purposes.
  • You acknowledge that your use of the Technology may be subject to third-party terms, such as (but not limited to) Apple's App Store Terms of Service.
  • You will not (nor allow third parties on your behalf to):
    • Make and distribute copies of any part of the Technology;
    • Attempt to copy, rent, sub-licence, loan, merge, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange, translate, hack, distribute, harm or misuse any part of the Technology; or
    • Create derivative works of the Technology of any kind whatsoever.
  • Pay any third party charges in order to use the Technology, including but not limited to any data charges levied by any mobile network providers.

5. System Requirements and Availability

We may release updates, patches, or new versions of the Technology from time to time. Where required, you agree to promptly install such updates to ensure the security and functionality of the Technology. You acknowledge and agree that the Technology is provided over the internet and mobile networks and thus the quality and availability of the Technology may be affected by factors outside SoMax’s reasonable control. SoMax, its group of companies and sub-contractors do not accept any responsibility whatsoever for unavailability of the Technology, or any difficulty or inability to download or access content or any other communication system failure which may result in the Technology being unavailable. SoMax will not be responsible for any support or maintenance for the Technology. To the maximum extent permitted by law, SoMax excludes all implied warranties in relation to the Technology. The Technology is provided ‘as is’ and ‘as available’ without warranty of any kind.

6. Privacy Policy

Your use of the Technology is also governed by the SoMax Privacy Policy, which you can access here: so-max.co.uk/privacy. Please review our Privacy Policy to understand how SoMax may collect, use, and disclose your personal information.

7. Termination

We reserve the right to terminate or suspend your access to the Technology at any time, for any reason, including but not limited to any breach of these Terms.

8. Disclaimers

Content Accuracy
We aim to provide accurate and up-to-date information, but we cannot guarantee the completeness, accuracy, or reliability of the content on the Technology. No information displayed or shared within the Technology should be considered as financial or legal advice.

Third-Party Links
We may include links to third-party websites or services. We have no control over these third-party sites and are not responsible for their content or actions. Your use of these sites and services is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, SoMax shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising out of your use of the Technology.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, and the English courts shall have exclusive jurisdiction over any dispute.
